Additional power to tackle anti-social driving.


Power to seize a vehicle driven anti-socially under s. 59 of the Police Reform Act 2002.
Anti-social driving is defined as careless driving, or off-road driving, which is causing, or likely to cause alarm, distress or annoyance to the public.
A warning must first be issued, which lasts for one year and applies to both the vehicle and the person.
If the same vehicle is driven in an anti-social manner again, by any person, or if the person issued with the warning drives another vehicle in an anti-social manner, the vehicle can be seized.
If a person drives anti-socially (as per the above definition), the are comitting an offence (either careless driving or off-road driving). Alongside the use of this power, the driver should be dealt with accordingly.
If the behaviour of the driver does not amount to an offence (either careless driving or off-road driving), the power cannot be used.
