On 25 March 2022 the law was amended to include any use of a mobile phone or other handheld device whilst driving.

What constitutes using a mobile phone?

  • Illuminating the screen.
  • Checking the time.
  • Checking notifications.
  • Unlocking the device.
  • Making, receiving or rejecting a telephone or internet-based call.
  • Sending, receiving or uploading oral or written content.
  • Sending, receiving or uploading a photo or video.
  • Utilising the camera, video or sound recording functionality.
  • Drafting a text.
  • Accessing stored data such as documents, books, audio files, photos, videos, films, playlists, notes or messages.
  • Accessing an application.
  • Accessing the internet.

What are the exceptions?

  • Calling 999 or 112 in a genuine emergency, when it is unsafe or impracticable to stop.
  • Making contactless payments whilst stationary.
  • Remote controlled parking.
