The power to seize motor vehicles driven without insurance or by an unlicensed driver.

Section 165A of the Road Traffic Act 1988 provides the power to seize a motor vehicle if it is driven on a road or public place without insurance, or when driven otherwise than in accordance with a licence.

Simplified

If, upon being required to do so by a constable in uniform –

A person fails to produce their driving licence, and there are reasonable grounds to believe that the vehicle is being or was driven without a licence.

A person fails to produce evidence of insurance, and there are reasonable grounds to believe that the vehicle is being or was driven without appropriate insurance.

A person fails to stop a motor vehicle when requested or fails to stop long enough for a constable to carry out lawful enquires and there are reasonable grounds to believe that the vehicle is being or was driven without a licence or insurance.

The motor vehicle can be seized.

To seize, a constable may –

Enter any premises (other than a private dwelling house) the vehicle is believed to be.

Use reasonable force, if necessary.

Seize within 24 hours if the vehicle failed to stop or left the scene.
